Applicability

These Terms & Conditions apply to all offers, orders and agreements concluded through www.thesecondbagboutique.com.

By placing an order, the customer confirms that they have had the opportunity to read and accept these Terms & Conditions before completing the purchase.

Any mandatory consumer rights under applicable law remain unaffected by these Terms & Conditions.

Nature and Condition of Our Products

The Second Bag Boutique specialises in pre-owned and vintage designer items.

Unless explicitly stated otherwise, all products have been previously owned.

Due to their pre-owned or vintage nature, items may show signs of age, wear, previous use, storage or natural variations in materials.

We describe and photograph the condition of each item as accurately as reasonably possible. Known relevant signs of wear or imperfections are disclosed in the product description and/or photographs.

An item described as being in “excellent condition” or similar condition terminology remains a pre-owned item and should not be expected to be identical to a brand-new item purchased directly from a designer boutique.

Customers are encouraged to review all photographs and descriptions carefully and to contact us at info@thesecondbagboutique.com if additional information or photographs are required before purchase.

The fact that an item is pre-owned or vintage does not affect the customer's statutory consumer rights. When determining what may reasonably be expected from a pre-owned item, its age, price, condition, description and any disclosed signs of wear may be taken into account.

Authenticity

The Second Bag Boutique guarantees that all designer items offered for sale are authentic.

Items are assessed and authenticated using appropriate authentication methods. Where applicable, third-party authentication services may also be used.

Any authenticity certificate supplied with a particular item will be stated in the relevant product description.

If there is a substantiated concern regarding the authenticity of an item purchased from us, please contact us at info@thesecondbagboutique.com so that the matter can be investigated.

Brand Disclaimer

The Second Bag Boutique is an independent reseller of pre-owned and vintage designer goods.

We are not affiliated with, associated with, sponsored by or endorsed by the designer brands whose products are offered on our website.

All trademarks, brand names and logos remain the property of their respective owners and are used solely to identify genuine products offered for resale.

Prices

All prices are displayed in EUR and include VAT where applicable.

For qualifying pre-owned goods, the VAT margin scheme may apply.

Shipping costs and any other applicable charges are displayed before the customer completes the order.

For orders delivered outside the European Union, customs duties, import VAT or other local charges may apply. Please refer to our separate Shipping Policy for further information.

Payment

Payment must be completed using one of the payment methods made available during checkout.

An order will only be processed after successful payment.

The customer is responsible for providing correct and complete payment and billing information.

Orders and Order Confirmation

After placing an order, the customer will receive an electronic order confirmation.

Because many of our items are unique, one-of-a-kind pieces, availability cannot always be replaced by an identical item.

We reserve the right to cancel an order where there is a clear and obvious pricing or technical error, suspected fraudulent activity, or where an item is unexpectedly unavailable.

If we cancel an order after payment has been received, all amounts paid for that cancelled order will be refunded using the original payment method.

Shipping and Delivery

Orders are shipped in accordance with our separate Shipping Policy.

The delivery times stated on our website are estimates unless a specific delivery date has expressly been agreed.

Where The Second Bag Boutique arranges the carrier, the risk of loss or damage during transportation remains with The Second Bag Boutique until the customer, or a third party designated by the customer, receives the goods.

If the customer independently appoints a carrier that was not offered by The Second Bag Boutique, different statutory rules concerning the transfer of risk may apply.

EU consumer rules provide that where no different delivery period has been agreed, goods should generally be delivered without undue delay and no later than 30 days after conclusion of the contract. European Union

Right of Withdrawal

Consumers who purchase online generally have a statutory right to withdraw from the purchase within 14 days after receiving the goods, without giving a reason. This right also applies to second-hand products. Autoriteit Consument & Markt

Detailed information regarding the right of withdrawal, return conditions, return shipping and refunds can be found in our separate Returns & Refunds Policy.

Nothing in these Terms & Conditions limits any statutory right of withdrawal.

Statutory Conformity and Consumer Rights

Products must conform to the agreement and to what a consumer may reasonably expect based on, among other things, the product description, age, condition, price and information provided before purchase.

The pre-owned or vintage nature of an item does not remove the customer's statutory rights.

Normal signs of wear or characteristics that were clearly disclosed before purchase do not automatically constitute a defect.

If an item does not conform to the agreement, the customer may have statutory rights to an appropriate remedy in accordance with applicable consumer law.

Nothing in these Terms & Conditions excludes or restricts rights that cannot legally be excluded or restricted.

Returns and Refunds

Returns and refunds are handled in accordance with our separate Returns & Refunds Policy.

That policy forms part of these Terms & Conditions.

Customer Responsibility

Customers should handle designer and vintage products with appropriate care.

The Second Bag Boutique is not responsible for damage resulting from misuse, accidents, improper storage, inappropriate cleaning or maintenance, alterations or normal wear occurring after delivery.

This does not affect liability for defects or non-conformity for which The Second Bag Boutique is legally responsible.

Liability

The Second Bag Boutique is liable where required under applicable law.

We are not liable for losses resulting solely from circumstances attributable to the customer or from improper use of a product.

To the extent permitted by law, we are not liable for indirect commercial losses suffered by customers acting in the course of a business or profession.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, nor does it limit mandatory consumer rights.

Intellectual Property

Unless otherwise stated, the original text, photographs, graphics, branding and other original website content created by or for The Second Bag Boutique are protected by applicable intellectual property rights.

Such content may not be reproduced, distributed or commercially used without prior permission, except where permitted by law.

Third-party trademarks, logos and brand names remain the property of their respective owners.

Complaints

If you have a complaint regarding an order or product, please contact us at:

info@thesecondbagboutique.com

Please provide your order number and a clear description of the issue so that we can investigate it properly.

We will endeavour to acknowledge and handle complaints within a reasonable period.

Your right to use any statutory dispute-resolution or legal procedure remains unaffected.

Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to an order is the version that was available to the customer at the time the order was placed.

Changes will not retrospectively reduce statutory rights relating to orders already concluded.

Governing Law

These Terms & Conditions and agreements with The Second Bag Boutique are governed by Dutch law.

For consumers, this choice of law does not deprive them of mandatory consumer protection provided by the law that would otherwise apply to them.

Any dispute will be submitted to a competent court in accordance with the applicable rules on jurisdiction.

For EU consumers, special jurisdiction rules may allow proceedings to be brought in the consumer's country of residence where the legal requirements are met. EUR-Lex
